Bretoi, Lutz & Stele, House Counsel for Mercury Insurance is currently seeking a Property Litigation Attorney to join our team in Southern California!

As a Property Litigation Attorney, you will provide legal representation to the Company before courts, arbitration panels, umpires, referees, or administrative bodies relating to the defense of First Party Property/Homeowner Claims and/or Lawsuits.

This position is remote working from your primary residence in Southern California but does require office work, travel, and appearances as needed to adequately defend the Company.

Essential Job Functions:

Assistance to Claims on a variety of issues including but not limited to preparing legal opinions to Claims leaders regarding recommended claims handling as required by statute; pre-litigation assistance on disputed claims; and providing assistance and advice on appraisals.

Complete comprehensive review of new file assignment with initial evaluation letter to claims and service of initial discovery within 30 days receipt of assignment.

Summarizing discovery responses and other pertinent records within 30 days of office receipt.

Taking and defending depositions/examinations under oath (EUO) of parties, lay witnesses and expert witnesses and completion of deposition summary within 15 days of receipt.

Law and Motion: Legal research; preparation of motions, oppositions and replies to motions; court appearance at law and motion.

Trial preparation, trial, and post-trial motions: This includes but is not limited to preparation of standard pre-trial documents, motions in limine and oppositions thereto; all facets of a jury trial, trial motions and post-trial motions.

Mentoring less experienced attorneys and other miscellaneous tasks as may be necessary to adequately defend the Company.

Education:

Requires a law degree and admission to the Bar in state(s) where practicing.

Experience:

Preferred 5-10 years' experience defending First Party Property/Homeowner claims/cases including EUO's, Appraisals, lawsuits involving breach of contract and breach of the covenant of good faith and fair dealing.

Knowledge and Skills:

Comprehensive knowledge of insurance, coverage, evidence, and civil procedure

Comprehensive knowledge of First Party Property Examinations Under Oath (EUO's), and First Party Property Appraisal process

Comprehensive knowledge defending First Party Property/Homeowner litigation

Effective communication, writing, and analytical skills

Attorney must be able to work independently with minimum direction and good organizational skills necessary to manage a high volume of cases

Must meet established Company standards regarding personal driving history and current license status to be eligible for position. Requires considerable automotive travel, up to 20% of work time
